DMX fails drug test; charges dismissed in Foxy Brown case

DMX will have to spend at least and extra week in an Arizona state prison for failing a drug test and a NY judge on Tuesday dropped charges that Foxy Brown violated a court order by mooning her neighbor when the woman told prosecutors she would not testify at trial.

DMX, 40 (real name is Earl Simmons), was given a year in prison in December after his probation was revoked for failing to submit to drug testing and driving on a suspended license. He was credited with the 117 days he spent in jail. He was to be released from prison in Yuma, Ariz. on Wednesday, but will now be released on July 19. DMX has been caught smoking twice, and once with drugs since January, according to prison records in a report by the Associated Press. He's been making 20 cents and hour as a porter.

As for Foxy Brown, whose real name is Inga Marchand, her trial for criminal contempt was to begin Tuesday but, her neighbor Irene Raymond told the Assistant District Attorney that she did not want to pursue the case. Brown described Raymond as someone who is jealous of her life.

Prosecutors said Brown violated a protection order in 2010 by screaming at Raymond and bending over showing her underwear and yelling obscenities. If the case went to trial, Brown's attorney said her defense would be that she did not moon Raymond and wasn't wearing underwear at the time, so Raymond was not telling the truth.

Brown was issued a protection order after pleading guilty in 2008 to menacing Raymond with her cell phone and is in effect until 2013. Brown's attorney said she would be filing a civil suit in Brooklyn alleging malicious prosecution.

Foxy Brown, 31, was a platinum-selling rap star in the 1990s but has stayed in the headlines in recent years for legal problems and hot temper. She also has said she suffered from hearing problems.
